2. Scope of Services
We offer residential and commercial air duct cleaning, HVAC cleaning, dryer vent cleaning, and related services. All services are subject to project-based proposals that outline scope, schedule, payment terms, and deliverables.
3. Project Proposals & Acceptance
Each project begins with a written proposal. Your written approval or down payment confirms acceptance of scope, materials, timeline, and cost.
4. Payment Terms
- Deposit: A non‑refundable deposit (typically 10–30%) is due on proposal acceptance.
- Progress Payments: Scheduled at predefined milestones or intervals.
- Final Payment: Due upon project completion, before handover or final inspection.
- Delays: Late payments incur interest at 1.5% per month or the maximum permitted by law.
5. Changes & Additional Work
All changes require written change orders detailing new scope, cost, and schedule.
Work may proceed only after the client signs the change order and any additional deposit is paid.
6. Timeline & Delays
We strive to meet scheduled completion dates.
Delays due to weather, design changes, permit issues, supply chain or site conditions are not grounds for breach.
7. Permits & Regulations
We handle necessary permitting unless otherwise specified. You must supply accurate site info (e.g., property lines, utility locations). Delays from missing or incorrect data will not be our responsibility.
8. Warranty & Quality
We warrant workmanship under industry standards for 1 year from completion.
Material warranties follow manufacturer terms.
Warranty claims must be submitted in writing. We’ll schedule inspection & correction promptly; workmanship failures warrant repair only, not replacement or reimbursement.
9. Access & Site Conditions
You must grant access to the site during work hours.
Provide utilities: water, electricity, and bathroom access.
Clear work areas; we are not liable for damages to items left in the area.
10. Client Responsibilities
Provide timely decisions, approvals, and selections.
Notify us of budget or scope concerns early.
Secure personal property and remove fragile items from work zones.
11. Safety & Insurance
We maintain liability insurance for our work.
We follow all safety regulations and keep the site as safe as reasonably possible.
You must carry homeowner’s insurance for your property and notify us of existing conditions or hazards.
12. Termination
Either party may terminate with a 7‑day written notice if the other breaches material terms and fails to cure.
On termination, you’ll pay for work done, materials ordered, and any costs associated with stopping work.
13. Intellectual Property
All website content (text, images, logos) is owned by us or licensed. You may not reproduce without permission. You grant us a license to use photos/videos of completed work for marketing.
14. Limitation of Liability
Our liability is limited to the total amount you’ve paid us.
We are not liable for indirect, incidental, or consequential damages, including lost profits, delays, or emotional distress.
15. Indemnification
You agree to indemnify us against all claims, damages, losses, and expenses arising from your negligence, false statements, or violation of these terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of San Jose, CA. Disputes will be resolved via negotiation or, if needed, arbitration in San Jose, under California arbitration rules. Each party covers its own legal costs.
17. Severability
If any part of these Terms is held invalid, the rest remain in full effect.
18. Changes to Terms
We may update these Terms from time to time. We’ll post changes here along with the “Last Updated” date. Continued use of the Site indicates acceptance of the revised Terms.
